Half Million Laid-off. What can you do if you are denied UC?
December 13, 2008 by Curt Siters
Times are rough and may get rougher before all is said and done. Layoffs have started in earnest. Banks, going against the directives of Congress are not lending. Businesses are starting to fold. New jobs are not opening up. Novembers new UC claims jumped to almost 600,000.
Where does this leave you?
If you are in a position where your hours are cut or eliminated you may be able to receive unemployment which, by the way, is only equal to a percentage of your pre UC application earnings. In most case it won’t cover all your bills.
Almost everyone will be able to receive unemployment compensation, but, what if you can’t?
There is an appeals process if you are denied. Do you know what your rights are in this situation? Do you know how to get through the system? Do you know and understand the process?
Most people will let it go and say “SHIT! Now what do I do?”
If you are smart you will get an attorney to help you. “WAIT A MINUTE! I just got laid off and can’t afford one!” you may scream.. “How do you expect me to hire an attorney?”
Well, you’re right and you’re wrong. Now that you’ve been laid off you can’t open the phone book, throw a dart and make a call. Most attorneys will not work for less than $30.00 per hour. Most are over $60.00 an hour.
There is an alternative - it is called Pre-Paid Legal Services. At Pre-Paid Legal we have a membership, where, for less than $30.00 per month you gain access to attorneys that will help you navigate the UC system in your state to make sure you get a fair hearing on you UC appeal. The great thing is, not only are you covered, but so is your spouse or domestic partner (six month minimum of relationship) as are your children under 18 and full time college students living at home.
If you can see that you may need a service such as this don’t hesitate to contact me.
